These Terms & Conditions (“Terms”) govern your access to and use of the website https://www.funkypanda.co.in/ (the “Site”) and the purchase of products offered by Atharav Enterprises through funkypanda.co.in (“we”, “our”, or “us”). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, you must refrain from using our Services.

1. Use of the Website

  • You agree to use the Site and Services for lawful purposes only.

  • You must not upload, create, or distribute any content that is illegal, defamatory, obscene, offensive, or infringes upon intellectual property rights.

  • Unauthorized access, data extraction, or misuse of our content is strictly prohibited.

 

2. Products & Custom Orders

  • Our product catalog includes predefined designs and user-submitted custom designs.

  • For custom orders, you are solely responsible for ensuring ownership and legality of the design provided.

  • We reserve the right to decline, cancel, or refuse fulfillment of any custom order containing:

    • Offensive or inappropriate content

    • Copyrighted or trademarked material without authorization

    • Content prohibited under Indian law

 

3. Pricing & Payment

  • All prices displayed on the Site are in Indian Rupees (₹) and inclusive of applicable taxes unless otherwise stated.

  • Payment must be made in full at the time of placing the order.

  • Payments are processed securely through our compliant third-party payment partners.

  • We do not store or access your card, banking, or financial details.

 

4. Order Fulfillment & Shipping

  • Orders will be processed only upon successful payment confirmation.

  • Estimated shipping timelines are provided on the Site; however, actual delivery may vary depending on location, logistics provider, or external factors.

  • We are not liable for delays caused by courier services, weather conditions, or other circumstances beyond our control.

 

5. Returns, Cancellations & Refunds

  • Returns, cancellations, and refunds are governed by our Return & Refund Policy and Cancellation Policy, available on the Site.

  • Predefined designs are eligible for return/exchange only in cases of damage or incorrect size/design.

  • Custom-designed T-shirts are non-returnable and non-refundable, unless defective or printed incorrectly.

  • All return/refund requests must be raised within 48 hours of delivery with valid proof (e.g., photographs).

 

6. Intellectual Property

  • All predefined designs, logos, brand elements, and content on the Site are the intellectual property of Funky Panda and may not be copied, modified, or distributed without prior written consent.

  • By submitting custom artwork, you confirm that:

    • You own or are authorized to use the submitted design.

    • Your design does not violate third-party intellectual property rights.

  • You agree to indemnify us against any third-party claims arising from user-submitted content.

 

7. Limitation of Liability

  • To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from use of our Site, Services, or products.

  • Our maximum liability, in any circumstance, shall not exceed the total value of the product purchased.

 

8. Privacy & Data Security

  • By placing an order or using our Services, you consent to our collection and use of your personal data in accordance with our Privacy Policy.

  • While we take reasonable safeguards to protect your information, we cannot guarantee absolute data security.

 

9. Modifications to Terms
